1. Acceptance of Terms

Welcome to Wrap & Roast. By visiting our restaurant, placing an in-store order, accessing our website, or placing an online order, you (“Customer,” “you,” or “your”) agree to be legally bound by these Terms & Conditions (“Terms”). If you do not agree to these Terms, please do not use our services.

Wrap & Roast reserves the right to modify these Terms at any time. Continued use of our services after any modification constitutes acceptance of the updated Terms.

 

2. Our Services

Wrap & Roast is a fast food restaurant based in New Jersey that provides the following services:

  • In-store dining and walk-in counter service
  • Online ordering via our website (www.wrapandroast.com)
  • Carry-out and takeaway orders
  • Promotional loyalty programs and special offers

 

We reserve the right to modify, suspend, or discontinue any aspect of our services at any time without prior notice.

 

3. Ordering & Payment

3.1 In-Store Orders

All in-store orders are considered final once payment has been processed at the counter. Customers are responsible for reviewing their order before payment is completed. We accept cash, major credit/debit cards, and approved mobile payment methods.

3.2 Online Orders

When placing an order through our website, you agree to provide accurate, complete, and current information. You confirm that you are authorized to use the payment method provided. All online orders are subject to availability and confirmation.

Order confirmation will be sent to the email address provided at checkout. Wrap & Roast reserves the right to refuse or cancel any order at our discretion, including cases of suspected fraud or pricing errors.

3.3 Pricing

All prices are listed in US Dollars (USD) and are subject to applicable New Jersey state sales tax. Prices are subject to change without notice. In the event of a pricing error on our website, we reserve the right to cancel the order and notify you promptly.

 

4. Refund & Cancellation Policy

 

⚠️  IMPORTANT: Please review this section carefully before placing your order.

Due to the perishable nature of food products, all sales are generally final.

Refunds and cancellations are granted only under the conditions described below.

 

4.1 Cancellation Policy

Online Orders:

  • You may cancel an online order within 5 minutes of placement, provided preparation has not yet begun.
  • Once our kitchen has begun preparing your order, cancellations will not be accepted.
  • To request a cancellation, contact us immediately at orders@wrapandroast.com or call 201-853-9756
  • Approved cancellations will receive a full refund to the original payment method within 5–7 business days.

 

In-Store Orders:

  • In-store orders cannot be cancelled once payment has been processed and the order has been submitted to the kitchen.
  • If you change your mind before submitting your order, please inform the cashier immediately.

 

4.2 Refund Policy

We stand behind the quality of our food. Refunds may be issued under the following circumstances:

 

✅  ELIGIBLE FOR REFUND:

   • You received the wrong item(s) that you did not order

   • Your food item contained a foreign object or was clearly unfit for consumption

   • Your online order was charged but never prepared or fulfilled by our team

   • A confirmed allergic ingredient was present despite a clearly communicated allergy


❌  NOT ELIGIBLE FOR REFUND:

   • Change of mind after food has been prepared

   • Food partially consumed before raising a complaint

   • Dissatisfaction with taste or spice level (subjective preference)

   • Incorrect order caused by customer error during online checkout

   • Delays caused by third-party delivery services (if applicable)

 

How to Request a Refund:

  1. Contact us within 24 hours of receiving your order.
  2. Email us at refunds@wrapandroast.com or call (201) 853-9756.
  3. Provide your order number, date of purchase, and a description of the issue.
  4. If applicable, include a photo of the incorrect or unsatisfactory item.
  5. Our team will review your request and respond within 2 business days.

 

 

4.3 Refund Processing

Once a refund is approved:

  • Credit/Debit Card Refunds: Processed within 5–7 business days back to the original card.
  • Store Credit: At our discretion, we may offer store credit or a replacement meal in lieu of a monetary refund, especially for minor order discrepancies.
  • Cash Payments (In-Store): Cash refunds will be issued at the restaurant location during operating hours upon management approval.

 

4.4 Partial Refunds

In cases where only part of an order was incorrect or unsatisfactory, we may issue a partial refund corresponding to the affected item(s) only, rather than the full order total.

 

4.5 No-Show & Uncollected Orders

For in-store pickup orders placed online: if you fail to collect your order within 30 minutes of the estimated pickup time without prior notice, your order may be disposed of and no refund will be issued. Please contact us promptly if you are unable to collect your order on time.

 

5. Food Allergens & Dietary Requirements

Wrap & Roast takes food allergies seriously. However, our kitchen handles common allergens including gluten, dairy, nuts, eggs, soy, and shellfish. We cannot guarantee a completely allergen-free environment.

If you have a food allergy or dietary restriction, you must:

  • Notify our staff at the time of ordering (in-store) or use the allergy notes field when placing an online order.
  • Consult our allergen menu, available at the counter or on our website.

 

Wrap & Roast is not liable for allergic reactions resulting from failure to disclose allergies at the time of ordering. Customers with severe allergies are advised to exercise caution.

 

6. Customer Conduct

All customers are expected to behave respectfully toward our staff and other guests. Wrap & Roast reserves the right to refuse service to any individual who:

  • Engages in abusive, threatening, or disruptive behavior toward staff or other customers
  • Attempts to defraud the restaurant (e.g., false refund claims, chargebacks without merit)
  • Violates any applicable laws or local ordinances on our premises

 

Individuals who are refused service due to misconduct are not entitled to a refund for items already prepared.

 

7. Website Use & Intellectual Property

Access to and use of our website (www.wrapandroast.com) is provided for the purpose of browsing our menu and placing orders. You agree not to:

  • Use the website for any unlawful or unauthorized purpose
  • Attempt to access restricted areas of the website or disrupt its functionality
  • Copy, reproduce, or distribute any content, images, logos, or trademarks belonging to Wrap & Roast without written permission

 

All content on our website, including logos, images, menu items, and written materials, is the intellectual property of Wrap & Roast and is protected under applicable copyright and trademark laws.

 

8. Third-Party Services

Wrap & Roast may integrate with third-party services including payment processors, online ordering platforms, and delivery partners. These services operate under their own terms and conditions, which we encourage you to review.

We are not responsible for the actions, policies, or failures of any third-party service provider. Any disputes arising from third-party deliveries should be directed to the respective delivery provider.

 

9. Limitation of Liability

To the fullest extent permitted by New Jersey law, Wrap & Roast shall not be liable for:

  • Any indirect, incidental, special, or consequential damages arising from the use of our services
  • Damages resulting from food allergic reactions where the customer failed to disclose allergy information
  • Losses caused by third-party service outages or delivery failures
  • Any unauthorized access to personal data beyond our reasonable control

Our total liability to any customer for any claim arising from use of our services shall not exceed the amount paid by that customer for the specific order in dispute.

 

10. Disclaimer of Warranties

Our services are provided on an “as is” and “as available” basis. Wrap & Roast makes no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or uninterrupted service availability. We do not warrant that our website will be error-free or free from viruses or other harmful components.

 

11. Governing Law & Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of the State of New Jersey, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the state and federal courts located in New Jersey.

Before initiating any legal action, both parties agree to attempt to resolve disputes informally by contacting Wrap & Roast directly. If a dispute cannot be resolved within 30 days, either party may pursue their legal remedies.

 

12. Indemnification

You agree to indemnify, defend, and hold harmless Wrap & Roast, its owners, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of our services, your violation of these Terms, or your violation of any applicable law or regulation.

 

13. Changes to These Terms

Wrap & Roast reserves the right to update or modify these Terms at any time. We will indicate the date of the most recent revision at the top of this document. Material changes will be communicated via our website or by email. Your continued use of our services following any changes constitutes acceptance of the revised Terms.
